1: Organising Company

The company Neaxia Management, VAT: 885987211. Located in 1070 Anderlecht, rue du Potaerdenberg 3a, is organising, in Belgium and the surrounding countries: Metropolitan France & Corsica included, the Netherlands, Switzerland, the United Kingdom, Germany, Spain etc., a contest with no obligation to purchase on its website: Gifts-custopolis.com which is its online shopping site.


2: Announcement of the Game

The Game runs from --/--/-- 00:01 to --/--/-- 00:00 inclusive.

The Game will be announced via:

c) Social networks: Facebook / Instagram / LinkedIn...


3: Participating products


The participating products are all the products sold on Gifts-custopolis purchased new from specialised suppliers.

4: Conditions of access to the Game

Participation in this game without obligation to purchase is limited to one participation per household, and with obligation to purchase, without limitation of participations. Each purchase of a new Gifts-custopolis.com product allows for an additional participation in the game without obligation to purchase.

The game is open to all natural persons of legal age (on the date of participation) residing in Belgium, metropolitan France (including Corsica), the Netherlands, Switzerland, the United Kingdom, Germany and Spain, etc.

Excluding members of the Organising Company's staff and their families, as well as any entity having participated directly or indirectly in the design, organisation, implementation and/or management of the Game.

The Organising Company reserves the right to exclude any participant who does not respect the fairness of the Game.

The participant's browser must accept cookies.


5: Rewards (Bonuses, prizes...)

5.1: Definition of prizes

The rewards put in play:

A product, vouchers, benefits, discounts, percentages on products sold on the site Gifts-custopolis.com, These are valid for one year from the date of issue for any order, regardless of the date.

These vouchers are valid either for a free product, a discount in €, or a percentage discount; however, other methods of reward may be offered.  

5.2: Details of the prizes

The Organising Company (Neaxia Management) will contact the winners, via the e-mail address registered during the competition. 

The prizes are non-changeable, non-exchangeable and non-refundable (if the prize is a product offered by the organiser).

The prizes may not be the subject of a request for financial consideration, exchange or return, for any reason whatsoever.

The Organising Company reserves the right, if circumstances so require, to substitute, at any time, for the bonus, a prize of equivalent commercial unit value and characteristics (after consulting the contest participant).

6: Terms and conditions of participation

6.1: Terms of participation

To participate, without obligation to purchase, in the "Gifts-custopolis Contest", the interested person simply needs to visit the Gifts-custopolis.com website before the end date of the contest.

a) Complete the online registration form (mandatory fields to be filled in: last name, first name, email address)


b) Answer the multiple choice questions.

 

c) Validate your registration by clicking on the "I want to win" button provided for this purpose.


d) No claims will be accepted more than 100 days after the end of the operation.


f) Only one participation per household.


6.2: Roulette: a Winning Instant

A Winning Instant is a computer program that determines that the connection corresponding to a certain moment (date, hour, minute and exact second) 

Once the registration has been validated, the participant will be informed as soon as possible whether or not he/she has won a prize. 

The results and the list of winners will be published on the blog of the merchant site at: custopolis-gifts.com.

All participants will receive a message confirming their win, the terms and conditions for obtaining their prize and the deadline for receiving it.


The winners of a Gifts-custopolis.com product will receive their prize by post, at the address you will have communicated to us by return mail after the announcement of your success in our contest. Other participants will also receive a gift, benefit or percentage or other benefit that will be determined at the beginning of the contest.  

The Contest is limited to one prize per household (same name and/or same email address and/or same postal address, the name corresponding to the postal address constituting a household).


In the interests of confidentiality, the list of winners will not be sent or telephoned.


7: Invalidity of participation

The Game managers reserve the right to refuse the prize, in particular if :


  • 1 winning participation has already been registered and validated within the same household (same surname/first name, same email address and/or same postal address and/or same invoice)

  • the postal address entered is false,

  • the surname and first name of the winner are unknown to the postal services at the address communicated when the game account was opened,


8. - Rules and Regulations

Participation in the Contest implies full acceptance of these rules.

No telephone enquiries regarding the interpretation or application of the rules, or regarding the terms and mechanisms of the Game, will be answered.

These rules are available on the Gifts-custopolis.com website (clickable tab "full rules") for the duration of the Contest and until 1 month after the end of the Contest.


9. Limitation of liability

9.1. Liability

The Organising Company shall not be held liable for problems inherent in the Internet connection, telephone communications, poor mail delivery or any other problem that is not attributable to it and that occurs throughout the duration of the Game.


The Organising Company shall make every effort to offer participants and maintain functional and verified infrastructures, information and tools. However, it shall not be held liable for the failure of participants' equipment (computer, software, Internet connection tools, telephone, servers, etc.), for the loss of data that may result from a cause not attributable to the Organising Company and for the impact of such failures on their participation in the Game.


It is therefore the responsibility of each participant to take all appropriate measures to protect their equipment and the data stored on their equipment (computer and telephone) against any attack. Participation in the Contest implies knowledge and acceptance of the characteristics and limits of the Internet network, the lack of protection of certain data against possible misappropriation or piracy by third parties and the risks of contamination by any viruses circulating on the network, or any other hazard related to postal services.


9.2. Participants

Participants accept that the data contained in the Organising Company's information systems have evidential value until proven otherwise, as regards the connection elements and information resulting from computer processing relating to the Game.

9.3. Operation of the game

The Organising Company undertakes to do everything in its power with its service providers to ensure the smooth running of the Game. Nevertheless, if a technical failure occurs and affects the proper running of the Game under conditions beyond the control of the Organising Company, the latter may not be held liable to the participants.


9.4. Winner's contact details

If a winner's contact details cannot be used or if the winner cannot be identified by name, postal address or e-mail address, it is not the responsibility of the Organising Company to make additional searches in order to find the unavailable winner, who will therefore receive neither his prize nor any compensation or indemnity.


9.5. Response time

In the event that the Organising Company does not manage to contact the winner by e-mail after 2 attempts, the winner who has not claimed his prize within 3 months following the date of the email notifying him of his prize, or who has not collected his prize during the time allowed by the Post Office, shall be deemed to have purely and simply renounced his prize. The prize will not be awarded and may not be claimed at a later date. It shall remain the property of the Organising Company.


9.6. Waiver by the winner

In the event that the winner expressly waives his right to benefit from his prize, the latter shall be retained by the Organising Company and may be used in the context of a subsequent operation, if the nature of the prize so permits, and without the Organising Company being held liable as a result.


10. Disqualification

Participants authorise all checks on their identity, age, address and telephone number in the context of the Game. Any participation that does not comply with these Rules, that is incomplete or with incorrect contact details will be considered null and void.

Any fraud or attempt at fraud, use of robots or any other similar process that makes it possible to play the game mechanically and/or to increase one's chances of winning by any means or otherwise is prohibited.

The Organising Company may thus exclude, suspend and/or definitively cancel the participation of one or more participant(s) in the event of the observation of suspicious behaviour consisting in particular of the implementation of an automated response system, the connection of several persons and different computer stations from the same participation profile, an unusual rate of winnings, an attempt to break into the organisers' servers, a multiplication of accounts, etc. The Organising Company may then not award the prizes to the participants concerned, based on the information in its possession, and/or prosecute the perpetrators of such fraud before the competent courts.


The Organising Company may also cancel all or part of the Contest if it appears that fraud has occurred in any form whatsoever, in particular in a computerised manner in the context of participation in the Contest and/or the determination of the winners.

In the event of a sanction or claim, participants must prove that they have behaved in accordance with these rules. The liability of the Organising Company may not be incurred in this respect.


11. Force majeure and modifications

The Organising Company shall not incur any liability whatsoever if, in the event of force majeure or events beyond its control or if circumstances so require, it is forced to cancel this Contest, to shorten, extend, postpone or suspend it or to modify the conditions thereof, and it shall not be held liable in this regard.

In any case, it reserves the right to extend the participation period.


12. Exoneration of liability

The Organising Company shall not be held liable for any defect or malfunction of the prizes.

The Organising Company declines all responsibility for any incidents or accidents that may occur to the winners during the use and/or enjoyment of the prizes.

It is the responsibility of the winners to take out the necessary insurance for the enjoyment of the prizes.


13. Authorisation to use the names, addresses and images of the winners

Subject to having obtained the express authorisation of the participant of legal age, the Organising Company may use the names, addresses and photographs of the winners, without this conferring on them any right to remuneration or any advantage whatsoever other than the award of their prize.


14. Intellectual property rights and copyright

In accordance with the laws governing intellectual property rights and copyright, the use of all or part of the elements subject to intellectual property rights or protected by copyright reproduced in the context of this Game is strictly prohibited, except with the prior written authorisation of the Organising Company.


15. Applicable law and disputes

The Game is subject to Belgian law.

Any dispute concerning the interpretation of the rules and/or cases not provided for in these rules shall be settled out of court. Failing that, they will be submitted to the courts of the jurisdiction of the Brussels Court of Appeal.


16. Protection of personal data

The personal information collected in the context of this Game is processed in accordance with the European Union Regulation.
